Response from the Workforce Remodelling Management Group: There are 2 aspects to this: a) liability insurance and b) personal accident. With regard to liability insurance, it is imperative that the school follows national regulations/policy and/or LEA policy/guidance with regard to the use of support staff and that the Headteacher is satisfied as to the capabilities of the person concerned. Where appropriate, a risk assessment should be carried out to demonstrate that potential problems have been considered. Subject to the above being complied with, then in the event of a claim arising in respect of injury to the employee (employers liability) or to a member of the public, including pupils (public liability), the liability insurance cover will protect the employer and the employee in the event of any claim for negligence arising from any incident.
