What is the general procedure for filing a Labor Certification?
An employer files the Labor Certification petition with the appropriate State Employment Security Agency (SESA); SESA reviews the application and may request modifications to the application; SESA issues a Job Order and the employer begins a job recruiting campaign under SESA’s supervision; After the job recruiting campaign is completed, the employer submits a detailed recruitment summary report, along with all requested evidence and supporting documents to the SESA for review;SESA reviews the report and issues a recommendation letter to the Department of Labor’s Regional Office (DOL);DOL regional office issues the final decision on the Labor Certification application.
