WHAT IS THE FUNCTION OF THE BOARD OF ZONING ADJUSTMENTS?
Zoning regulations are designed for the typical situation. Sometimes there are physical characteristics with a piece of property which are unusual and create a unique problem which is not generally found with other pieces of property. When such unique conditions exist, the Board of Zoning Adjustments can consider granting a variance from a specific physical dimensions requirement such as a setbacks. The board can also review cases where an individual disagrees with the interpretation of the ordinance and other specific development cases. The board cannot grant land use exceptions such as building a duplex in a single-family zone or allowing a use which is not allowed by the ordinance. Also the board cannot grant variances if something was constructed without a permit and the only reason a variance is being asked is so the constructed item does not have to be moved.
