What is the eligibility criteria for the over 65 provisions–release criteria–of the Second Chance Act?
Must be over 65, no violence, no sex offense and must have served a minimum of ten (10) years and/or seventy five percent (75%) of the sentence. WHICHEVER IS GREATER.. The Statute states: “75% of the term of imprisonment to which the offender was sentenced” As of September 30, 2008, the Federal Bureau of Prisons preliminary assessment as to the number of eligible inmates is a mere 83.
