What is the Effective Date?
Effective Date shall mean the date on which the Judgment becomes Final. Final means the termination of the Litigation after each of the following events: (i) the Settlement Agreement is approved in all respects by the Court; and (ii) a Judgment of dismissal with prejudice is entered with respect to the Plaintiffs and all Settlement Class Members who do not Opt-Out as provided by Rule 23 of the Federal Rules of Civil Procedure and the time for the filing of any appeals has expired (30 days) or, if there are appeals, approval of the Settlement and Judgment has been affirmed in all respects by the appellate court of last resort to which such appeals have been taken and such affirmances are no longer subject to further appeal or review. Update: The Court entered a Final Approval Order on June 4, 2007. An appeal was filed. Update: The Effective Date has been set at September 6, 2007. The Settlement is now completely final. The appeal has been resolved.
