What is the dispute resolution procedure under the Horticulture Code?
A dispute is any disagreement between two or more parties to a horticulture produce agreement. Growers and traders can use the procedure set out in the Code to resolve disputes or they may choose another dispute resolution procedure to resolve a horticulture dispute. However, even if a grower and a trader have agreed on a dispute resolution procedure which differs from the procedure set out in the Code, if one of the parties decides to initiate the procedure set out in the Code, the other party must participate in that process. Traders and growers can also appoint a horticulture produce assessor to investigate and report on any matter arising under a horticulture produce agreement (see questions under part 6 below).
