What is the difference in instructing the Contractor to work faster to achieve Scheduled Progress under clause 11 and telling the Contractor to accelerate under clause 45 ?
An instruction under clause 11.3 may be given if the Contractor is not achieving Scheduled Progress. The steps taken by the Contractor to achieve Scheduled Progress are at the Contractor’s cost. However under clause 45 the Principal could instruct the Contractor to accelerate progress of the Works at the Principal’s cost by issuing an “Acceleration Notice”, where the Principal requires accelerated progress of the Works. Clause 45 is not drafted on the basis of the Contractor being behind Scheduled Progress.
