What is the difference between State Jurisdiction and Federal Jurisdiction ?
The Miccosukee Indian Reservation occupies land within the Northern part of Everglades National Park. Since, the Everglades National Park is a federal park, this land is exclusively under Federal Jurisdiction. However, most of the Miccosukee Indian Reservation occupies land within both State and Federal Jurisdictions. Depending on where the crime occurres, will depend on whether it is a Federal crime, under U.S. Title Code 18 or a State crime, under Florida State Statutes. Some crimes are committed under both sets of laws and prosecution of these cases depends on the U.S. Attorney’s Office or the Broward/Dade State Attorney’s Office. The Miccosukee Police Department is committed to prosecute these cases to the fullest extent of the law.
