There is a difference between spousal support and alimony pendente lite. Both are forms of support for the spouse and both are calculated the exact same way but with spousal support one does NOT need to file a divorce complaint in order to be eligible to receive it. However, there are defenses to spousal support. For example, if one spouse requests spousal support the other spouse could assert an “entitlement” defense claiming the other spouse is not eligible for some reason.
