What is the Difference Between a “Trade Secret” and “Confidential Information”?
Prior to the adoption of the Minnesota Uniform Trade Secrets Act, trade secrets were protected under the “common law” of trade secrets developed by the Minnesota courts over the years. After adoption of the Act, however, the Minnesota Uniform Trade Secrets Act replaced the body of case law regarding the protection of common law trade secrets in favor of the specific statutory provisions of the Act.
