What is the difference between a simple offence and an indictable offence?
A. A simple offence is an offence where the Magistrate can hear and make a determination in the lower court. Common simple offences are public nuisance, trespass and traffic matters. An Indictable offence can either be determined in the lower court at the election of prosecution or the defence in certain cases. For other offences, they must be moved to a higher court to be finalised.
