What is the difference between a petit jury and a grand jury?
Petit juries listen to the evidence in a particular case and decide whether a person is guilty or not guilty. A typical petit jury for a felony case may consist of 12 jurors. States constitutions, statutes, or both often allow for a smaller number of jurors in misdemeanor cases. Juries are also used in civil trials. However, grand juries do not decide guilt or innocence; rather, they decide whether there is sufficient evidence to indict an individual or, in the case of investigatory grand juries, they recommend a course of action to the prosecution.
