What is the difference between a Judge Pro Tem and a Fulltime Judge?
It is very important that voters understand the difference between a Judge Pro Tem and a Fulltime Judge because they are NOT the same. Generally, a Judge Pro Tem works only a few hours each year handling limited cases. Judge Pro Tem’s are called upon when Judge’s are out sick or unavailable and they are limited in their authority. In Benton County, Judge Pro Tem’s do not normally handle civil or criminal jury trials, criminal suppression hearings, nor are they authorized to issue search warrants.
