All motions are generally considered non-hearing. That is, a hearing on the motion will not be held, and the Board will decide the motion on the written submissions. You must prepare, file, and serve on the other side a Notice of Non-Hearing Motion. A sample is found here. Form 2 – Notice of Non-Hearing Motion The Board may request that a hearing be held, even if the motion is submitted on a non-hearing basis. If you want to have a hearing on the motion where the parties can present oral arguments in addition to the written submissions, you must call the Board to obtain a hearing date and time, and prepare, file, and serve on the other side a Notice of Hearing.
