Basically they are the same in that the court is asked to decide how custody, support, property, and debts should be handled. The main difference is in the final result. In a legal separation, the couple stays married since the marriage is not dissolved. Often times a petition for separate maintenance is used when a parties religious beliefs prohibits them from obtaining a divorce.
