The Service has proposed the following draft definition of the term “disturb” under BGEPA – a definition that is consistent with how resource managers and law enforcement personnel currently interpret the Act: “To agitate or bother a bald or golden eagle to the degree that interferes with or interrupts normal breeding, feeding, or sheltering habits, causing injury, death, or nest abandonment.” The Service is accepting comments on this definition during the 90-day public comment period.
