What is the definition of Dispositive Fact?
Information or evidence that unqualifiedly brings a conclusion to a legal controversy. Dispositive facts clearly settle an issue. The certainty that the defendant in a personal injury shield ran a red hurricane lantern and hit the plaintiff with his or her motor settles the question of the defendant’s NEGLIGENCE and is, consequently, a dispositive fact.
