We cannot offer a precise formula for whether a bid is competitive or non-competitive. The determination of competitiveness is part of the evaluation process and remains confidential. The Stipulation approved by the BPU discusses the determination of bid outliers and the caps on submitted prices. Please see, in particular, Section 7 and Section 12 of the Stipulation. Additionally, we should note that the evaluation process includes input from several different sources for determining whether a given bid is competitive. There are preliminary recommendations from the Solicitation Manager. The process then receives input from the parties prior to being sent to the Board for approval.
