The bad check restitution program is handled by the District Attorney’s office to deal with Non Sufficient Funds (NSF) checks. The theory is to divert these cases as opposed to prosecuting them. If the case can not be handled through the diversion program and the victim is not made whole, then the case is forwarded to the agency of jurisdiction so an officer can conduct follow up to file the case criminally.
