What Is The Automatic Suspension When Alcohol/Chemical Test Is Refused Or Results?
Under Maryland law, a charge of DWI where the driver’s BAC is .10 or higher will result in the automatic suspension of driving privileges for some period of time. The length of suspension, and the ability of the Motor Vehicle Administration (MVA) to modify the suspension to allow limited driving privileges during the period of suspension, will depend on whether it is a first or subsequent offense and/or whether the breath or blood test was taken or refused.
