As per the Uniform Trust Code’s Section 704, any vacancy in a trust has to be filled by the appointment of a successor trustee. If a trustee resigns or dies, then that vacancy has to be filled by another person. Usually creditors are allowed to select this successor trustee and in the failure of which a successor trustee gets appointed by the Bankruptcy court.
