What is the Appellant’s Initial Brief and Designation of Matter?
The initial brief and designation of matter set forth the arguments and the evidence that you want to put before the Court of Appeals. For guidance in these matters, you must carefully study Rules 208 and 209 along with Forms 12 and 13. Only one copy of the initial brief and the designation needs to be filed. When filing the designations, you should not send copies of the documents themselves. Simply make a list of what you want included, in the manner shown in Form 13. Keep in mind that nothing can be designated that was not included in the proceedings before the lower court.
