What is significance of confirmation of freezing order by the Competent Authority?
Under the Act all seizing /freezing order has to be confirmed by the Competent Authority within one month of it being made. Before confirmation the concerned person is given an opportunity to establish that his properties are legally acquired properties. This action is required in the interest of natural justice. Once the Competent Authority confirms an order under Section 68 F, the properties under the order are received and managed by an Administrator appointed by the Government till its final forfeiture or release. Transfer of any property against which order passed under section 68 F has been confirmed, has to be ignored for forfeiture proceedings and if the properties are subsequently forfeited , the transfer has to be treated as null and void.
