Where an employee has been recalled to work by his or her employer and the recall was not scheduled in advance, the employer shall pay to the employee compensation equivalent to four hours pay at his or her regular rate of pay whether or not the employee is called on to perform any work after reporting for work. A recall cannot be scheduled in advance. Work scheduled in advance is not a recall. The amount of advance notification is not spelled out in the regulation, however the amount of advance notification needs objectively to be reasonable taking into account the circumstances of the recall. Recalls are payable either at regular time (4 hours) or at overtime (2 hours 40 minutes) depending on the number of hours previously worked in the day or week. Whether an on-call employee is entitled to receive recall pay if recalled, depends on the employees individual circumstances.
