What is proof of negligence?
The following requirements must be met to prove negligence: • Existence of a duty to use reasonable care. • Breach of that duty by careless or unreasonable action. • Injury was a forseeable possible result of that action/inaction. • Injury was caused by the careless/unreasonable action/inaction. Once the defendant is proven negligent, you have the right to recover your damages.
