What is meant by the term “nuisance”?
In terms of the Environmental Protection Act 1990 a statutory nuisance occurs where smoke, fumes or gases emitted from any premises are such as to be prejudicial to health or a nuisance. A bonfire which emits smoke or odour for long periods could be regarded as a public health nuisance and as such, the local authority could serve notice on the person responsible should a complaint be received.
