What is legal separation and what are the advantages to it in a divorce?
Legal separation is everything a divorce is except the final dissolution does not occur. The main benefit is that the health insurance stays intact and with the state of health insurance in our country today that is a huge benefit. Very often if one spouse is ill it is to their best interest to file legal separation and remain the status of the marriage; however, if the other spouse wants a dissolution and he files for a dissolution as oppose to a legal separation that trumps the legal separation. So generally, hopefully you’re in good conversation with your ex-spouse and you can work together on that, but the main advantage as I see it is the benefits the other spouse has to his or employer.
