What is Home Electronic Monitoring (HEM)?
A. Home Electronic Monitoring (HEM) is also known as house arrest and allows you to leave the jail and stay in the comfort of your own home. Often, HEM is granted when an accused asks for bail but the judge is reluctant to set the accused totally free. Skilled attorneys are sometimes able to get the judge to allow their client to receive HEM while awaiting sentencing hearings, or even satisfy their clients incarceration where the charges are relatively minor. Be warned, however, that HEM can cost in excess of $300 per month and requires that your residence have telephone service. If you are incarcerated, it is important that your attorney try to get you bond, or if you are unlikely to get bond, to try to get HEM for you. As a former prosecutor, I know the concerns that often go through the prosecutors and judges minds when HEM is requested and will try to alleviate their concerns about your release on bond or HEM.
