What is FERPA?
The Family Educational Rights and Privacy Act of 1974 protects the confidentiality of student records. FERPA governs (1) the release of educational records maintained by the university and (2) access to these records. Without a signed FERPA form on file with the University, information regarding a student’s record cannot be released to a third party. Parents are considered a third party. FERPA is the Family Educational Rights and Privacy Act. It is a Federal law designed to protect the privacy of student educational records. From the time a child enters preschool until the child completes 12th grade, the parent has certain rights regarding their children’s education records. Once the student turns 18 or once they are enrolled in a post-secondary school, those rights are transferred from the parent to the student. For the student who is enrolled at GCC this means: The student has the right to inspect and review their educational records. The student has the right to request a school correct records he or she believes is inaccurate or misleading. There must be written permission from the student allowing information to be released to a 3rd party. This means we cannot disclose information about the student’s grades, attendance, course load, financial aid status, etc. without the written permission of the student. The three primary rights are: • students can inspect and review their educational records • students can seek to amend their educational records if they believe the records contain inaccurate information • students have some control over the disclosure of information in their educational records. • Any information that schools define as “Directory Information” can be disclosed without written consent unless students place a release hold on some or all of this information.
