What is Domicile? Does it affect my foreign divorce?
Your domicile refers to your place of birth. If you are emigrating and intend to settle there indefinitely then that country becomes your domicile.If you intend returning to your country of birth eventually, then your country of birth is still your domicile. How it affects your foreign divorce depends on when it was obtained. Before 1986 there was an anomaly regarding the definition of domicile which affected the recognition of foreign divorces. Where both spouses were domiciled in the same foreign country, no difficulty arose. Where the wife was domiciled in a foreign country other than that of her husband then she had to take the domicile of her husband.This was known as a dependent domicile. In Ireland the Domicile and Recognition of Foreign Divorces Act 1986 was introduced to correct that inequality. This act abolished the concept of dependent domicile of a wife and from that date a wife was capable,in law, of having independent domicile. The recognition of foreign divorces is curr
