What is Diversion?
Diversion is offered to offenders who meet a specific criteria. Those who are eligible will have the option of completing a counseling program designed to prevent the defendant from committing this type of crime in the future. Upon successful completion of the program, the charges will be dismissed. Upon request of the victim, the views of the victim shall be considered in determining diversion eligibility.

According to Public Resources Code (PRC) section 40124, diversion is generally defined as the reduction or elimination of the amount of solid waste from solid waste disposal. Excluding a few mandated exceptions, the States definition of diversion is intentionally broad to allow each jurisdiction the flexibility to develop whatever information it needs to manage its programs and meet its diversion goals. However, for the purpose of this guide, diversion is defined as the quantity and type of solid waste material generated within a jurisdiction, which is not disposed at Board-permitted solid waste transformation and disposal facilities. Many cases involving juveniles are not heard in court. The child’s case is handled by another agency, usually a public or private social services agency. This is known as “diversion.” The child, the child’s parents and the agency come to an agreement about how to handle the child’s offense. This will often involve meeting certain conditions, such as, restitution, community service, counseling or school attendance. If the child meets all of the agreed conditions, the case will be dismissed without court action. If the conditions are not met, the child may be referred to juvenile court.
