What is Customs Protection of Intellectual Property Rights (IPR) in China?
Under Regulations of the People’s Republic of China Governing Customs Protection of Intellectual Property Rights, IPR owner may seek Customs protection by the following two patterns. (a) Passive Protection Customs authority may, under request of an IPR owner, detain the suspected goods discovered by the IPR owner. Such protection has the following characteristics: The IPR is not recorded with the General Administration of Customs of P. R.l China. Customs authority is not responsible for surveillance of anyl imported and exported goods that are suspected to have infringed the IPR. Where the IPR owner discovers any imported and exported goods that arel suspected to have infringed its IPR, it may request relevant Customs authority to detain the suspected goods, The IPR owner should provide the Customsl with a guaranty of no less than the equivalent value of the suspected goods.
