What is changing regarding limitation of liability limits?
Effective Monday, November 2, 2009, NASDAQ OMXSM will modify the daily limits in the limitation of liability rules for The NASDAQ Stock Market® and NASDAQ OMX BXSM (BXSM). NASDAQ® and BX will eliminate the $100,000 and $250,000 daily caps on liability. All claims of order processing failures on those markets will now be subject to the already existing $500,000 monthly liability cap. In the event that all claims during a calendar month exceed the maximum, the $500,000 will be proportionally allocated among all eligible claims.
