What is BWI?
The legal definition of boating while intoxicated (BWI) is similar to that of driving while intoxicated (DWI), although the penalties are somewhat less severe. Boating with a BAC above .08 or with other drugs or controlled substances in the person’s system is considered boating while intoxicated. It is a Class B misdemeanor, and is punishable by at least 72 hours in prison. Although it may seem like a relatively minor offense, a BWI conviction can have long-lasting repercussions.
