You probably need to sit down with an Enrolled Agent (look in your yellow pages under TAXES) and discuss this. There is NO ‘pat’ answer to this as there are many variables! There are some deductions that are lost if you file a MFS and if one person itemizes, the other person must also itemize even if he/she has nothing to itemize. AND not to mention: that is the highest tax bracket you can be in! BUT if someone has unpaid taxes, unequal withholding, etc…better to pay someone to sort this out for you and see what is the best way to go.
