What is an indictable offence in Canada and where can I find examples of such offence?
An indictable offence is a serious criminal offence, the crown reads off the charge(s) to the offender and in most cases he/she is given 3 choices; 1) Have the case heard in provincal court by a judge alone 2) Have the case heard in a superior court by a judge and jury 3) Have the case heard in superior court by a judge alone. There are three types of indictable offences; Section 553 offences (less serious) they are always tried in a provincal court without a jury and the maxium penalty for these is 2 years. Examples of section 553 offences- breach of bail, mischief under $5000, theft under $5000, assaulting a peace officer. Then there is section 561 offences- These are moderaltely serious offences and the accused has a right to choose where he wants his case to be heard and wheter or not he/she wants a jury.
