The engagement of an expert or neutral person for any current or anticipated litigation or dispute is exempt from the requirements of the MPPs (Exemption 7, CPGs). An expert or a neutral person includes mediators, conciliators, arbitrators and facilitators, counsel and barristers, engaged with respect to a current or anticipated litigation or dispute. The exemption may be extended to professions other than counsel or barristers where the purpose of the engagement is for any current or anticipated litigation or dispute. Unless there is a current or anticipated litigation or dispute, this exemption cannot be used.
