What is an affidavit? How do I prepare one for court?
An Affidavit is legal document that is a written oath about facts and/or evidence that support your case. Some cases do not require an affidavit, whereas others may. The affidavit is sworn under oath in front of a commisioner of Oath, and/or a lawyer (do not need a lawyer to prepare an affidavit). Your affadivit MUST be filed with the court, (the court clerks will help you with that) and a copy MUST be presented to each party in your case. When you prepare your affidavit, only tell the truth, and facts that are relevant to your case. Personal opinions should not be included. Stay on topic, and avoid vague information. Depending on your judicial court, the header style may vary, generally you state the deponent (the person making the affidavit), Plaintiff and Defendant. and the court.
