What is an “accident” within the meaning of Florida’s Workers Compensation Law?
“Accident” means only an unexpected or unusual event or result that happens suddenly. However, only acceleration of a condition or death or acceleration or aggravation of a pre-existing condition that is reasonably attributable to the accident is comprehensible. Exposure to toxic substances, for example, does not constitute an “accident” unless there is clear and convincing evidence establishing that exposure to the specific substance involved.
