What is addressed in the Memorandum of Understanding?
The result of the mediation sessions is a document called a Memorandum of Understanding (MOU). This Agreement captures all the issues that must be determined in the course of separation or divorce. These issues include equitable distribution of marital assets, parenting time, legal and residential custody, maintenance (commonly called alimony), child support and any other subjects the couple elected to address. In New Jersey, the MOU is taken to a review attorney who uses it to draft the Property Settlement Agreement (PSA). The PSA is filed with the court.
