What is a substantial defect?
A substantial defect can be defined as any defect that substantially impairs use, value or safety of the vehicle. Common examples would include faulty brakes, ABS brake failures, transmission failures and “hard-shift” or “no-shift” situations, engine dying complaints, major electrical difficulties with the vehicle, on-board computer malfunctions, repeated no-start situations, and others.
A “substantial defect” is a defect or problem that affects the use, safety or value of the vehicle. A “substantial defect” may include recurring problems to the engine, transmission, seatbelts, electrical or air conditioning system. Examples include loss of power, check engine light, SRS light, faulty air conditioning, etc.
