What is a Probate or Succession Proceeding?
A Succession Proceeding is prepared when a person dies. The purpose of the proceeding is to put the heirs or legatees into possession of the Deceased’s estate. Depending on the amounts and types of assets and liabilities of the estate, whether there was a will or not, the classification of the prospective heirs or legatees, whether any state or federal inheritance taxes are due, an attorney will be able to recommend whether a Succession proceeding is necessary.
