What is a “party wall” in a planned development?
The term “party wall” in a planned development usually means a wall, fence, or other building element that sits on the border of two or more lots. Sometimes the CC&Rs will define “party wall” more broadly so that it includes any building element that is within a prescribed distance of the lot border. Where party walls exist, the CC&Rs will usually allocate responsibility for maintenance, impose restrictions on alterations, and provide access rights for maintenance.
