WHAT IS A NONCONFORMING USE CERTIFICATE AND HOW DO I OBTAIN IT?
Ogden is an older city and many changes have taken place to the zoning ordinance and the zone designations. A nonconforming use is one that was legal and met the requirements of the zoning ordinance when it was built, but through the changes of rules does not meet the present requirement. Because it was legal when it was created, it is allowed to continue. The City issues a nonconforming use certificate that acknowledges the right of the use to continue. This certificate is helpful when properties are being sold or refinanced so future owners know what they are obtaining is legal. To obtain a nonconforming use certificate, information needs to be gathered such as when the building was built, what was the present use first in the building, what are all the improvements on the property, and any other information that will help to insure the use was legal at that time period.
