What is a nonconforming lot, structure or use?
A. A nonconforming lot does not meet the lot dimension and area requirements set by the pertaining zoning district guidelines found in this section of the Town Code. These lots are essentually too small, or narrow or flag shaped. They are given decreased setbacks to compensate for the difference in anticipated and real size of the lot. Nonconforming structures are those buildings being built not in conformance with the current code, by either being built within setbacks, too tall, or on commercial properties the most common nonconformity is not having adequate parking or landscaping. Nonconforming uses are those that conflict with the current uses allowed in the zoning district for the property. ie: a commercial use on a residentially zoned property, or visa versa. Although the nonconforming lot, structure or use may continue to exist, it may not be expanded. Many people refer to this as “Grandfathering”.
