What Is a Modular Home?
A modular home is built using a highly engineered method of producing buildings or building components in an efficient and cost effect manner. The home is built in a factory and then carried by sections to the site where it is put together by a local builder. The use of building systems is common in many different types of residential and commercial construction. Modular homes are not the same as manufactured homes. Manufactured Homes comply with the Federal Construction Safety Standards Act (HUD/CODE), which requires homes to be constructed on a non-removable steel chassis. Many communities have restrictions on where manufactured homes can be located. Modular homes are constructed to the same building code required by your state, county, and specific locality and therefore are not restricted by building or zoning regulations. Modular homes are also built in factories, transported to a site location and installed. Modular homes are governed by the building code enforced in the jurisdiction where the home is to be located. These codes can be BOCA National Building Code, the ICBO Uniform Building Code, the Southern Standard Building Code or the ICC One and Two Family Dwelling Code.
A modular home is different than a mobile home or a manufactured home. It is a structure that is built off-site, transported to a building site, and permanently installed (that is, not intended for removal and relocation at a later time). The Zoning Ordinance defines modular homes in Section 19-301.
Title 42 United States Code 3282.12 (42 USC 3282.12) states that the term includes “Any structure that meets the definition of manufactured home at 24 CFR 3282.7(u)” but “is excluded from the coverage of the National Manufactured Housing Construction and Safety Standards Act, 42 U.S.C. 5401 et seq.,” and for which the manufacturer issues a certification that states the following: ” The manufacturer of this structure, Name _______; Address ______ (location where structure was manufactured) certifies that this structure (Ser. No. ______) is not a manufactured home subject to the provisions of the National Manufactured Housing Construction and Safety Standards Act and is- (1) designed only for erection or installation on a site-built permanent foundation, (2) not designed to be moved once so erected or installed, (3) designed and manufactured to comply with ________ (Here state which code included in paragraph (b)(3) of this section has been followed), and (4) to the manufacturer’s knowle
