What is a material or substantial change in circumstances?
The most defined changes that warrant a modification are if a child turns or is older than 12 and files a preference with the court to change primary conservatorship (generally who the child lives with during the week) to the other parent or if the parent with primary custody has relinquished care and control of the child for over 6 months. After that, it is a case-by-case determination as to whether the change in circumstances is considered material and substantial.
