What is a lien search?
A. The phrase “lien search” is a misnomer as lien typically suggests a recorded instrument. Actually a lien search is research conducted on real property to ascertain if there are any unrecorded liens and/or potential liens, assessments or fees which could be assessed and encumber a property, possibly as a lien, at a future date. The potential fees can stem from county and/or municipal ordinances or from Florida Statutes, such as F.S. Chapter 159, among others hence you will sometimes hear a lien search referred to as a “Chapter 159” search. A lien search is also often called a “Municipal Lien Search” as well. Lien searches are customarily required for the purposes of issuing title insurance to a lender and/or a purchaser in the State of Florida and they are typically performed by or obtained by the settlement agent.
