WHAT IS A LEGAL CONFORMING CERTIFICATE AND HOW DO I OBTAIN IT?
A legal conforming certificate applies only to duplexes (two units in one building). A legal conforming certificate allows a building to be used as a duplex, no matter who the owner is and allows it to be rebuilt without any special review procedures should the building be destroyed. A legal conforming certificate is issued by the City if it can be shown that when the building was built or converted to a duplex it met the lot area requirement and the parking requirement of the zoning ordinance of that time period. Even if the property is now zoned only for single-family homes, the legal conforming certificate will allow the building to be used as a duplex. To obtain the certificate, a drawing showing the parking and the building on the lot is needed together with information as to when the building became a duplex. If all the information meets the criteria mentioned above, a certificate will be issued.
