What is a European company / SE?
The European company (also: Societas Europaea – SE) is a new legal form for companies in the EU. It was created on the basis of Council Regulation (EC) No. 2157/2001 of 8 October 2001 on the European Company Statute (SE)” and “Council Directive 2001/86/EC of 8 October 2001 supplementing the European Company Statute with regard to the involvement of employees”. These EU regulations enable the cross-border establishment of an SE, among others, through the merger of stock corporations from various EU member states. The implementation of the EU regulations by the German legislator was achieved through the “Gesetz zur Einführung der Europäischen Gesellschaft (SEEG)” (= law on the establishment of the European company).
